PDLegal LLC’s Managing Partner Raghunath Peter Doraisamy FCIArb and Associate (Registered Foreign Lawyer) Pranav Kamnani have recently published an article titled “Arbitration Agreements and Insolvency Proceedings: Comparing the Pro-Arbitration Perspectives in Singapore, the United Kingdom, and India, and Calling for International Consensus” on the Kluwer Arbitration Blog.
The article focuses on the legal position in Singapore, United Kingdom and India and analyses the approach adopted by courts in these jurisdictions when faced with winding up and/or insolvency proceedings pending arbitration.
The article compares the commonalities of the approach in the three jurisdictions and concludes by emphasizing issues that remain unclear and require consideration. The article finally calls for an international consensus for streamlining the interplay between arbitration and insolvency laws to promote efficiency in international business and advance the objective of the UNCITRAL Model Law on International Commercial Arbitration.
