Partners, Peter Doraisamy and Gerard Quek co-authored the Legal opinion on Directors’ responsibilities and Climate change under Singapore Law, which is commissioned by the Commonwealth Climate and Law Initiative (CCLI). The other co-authors of the legal opinion are Mr Jeffrey Chan SC (Lead Author), Dr Joseph Chun and Dr Ernest Lim. The co-authors were assisted by Mr Jarret Huang in his personal capacity.
The legal opinion cautions that company directors in Singapore must take climate change seriously or risk personal liability. The obligation to consider climate change forms part of a director’s duty to act in the best interests of the company. Given that climate change has been formally accepted by various jurisdictions as a global emergency and a threat to mankind, this legal opinion would, among other things, serve to remind directors of their duties in respect of climate change.
